INTRODUCTION

Welcome to Twiggle.

These Terms and Conditions ("Terms") govern your access to and use of the Twiggle website, platform, applications, services, content, features, and related offerings (collectively, the "Platform").

The Platform is owned and operated by Twiggle Labs Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office in Thane, Maharashtra, India ("Twiggle", "Company", "we", "our", or "us").

By accessing, browsing, registering for, subscribing to, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must discontinue use of the Platform immediately.

ABOUT TWIGGLE

Twiggle is an AI-powered learning ecosystem designed to help students learn, practice, receive feedback, stay motivated, and improve learning outcomes.

The Platform may include:

• Interactive learning content
• Personalized learning pathways
• Practice questions and assignments
• Assessments and tests
• AI-generated feedback
• Learning analytics
• Progress tracking
• Educational chatbot services including "Ask Twiggle"
• Parent dashboards and related features

The Platform is intended solely as an educational support tool and should not be considered a substitute for formal schooling, classroom teaching, tutoring, parental guidance, or independent study.

ELIGIBILITY

The Platform is primarily intended for students in Grades 4–8 and their parents or legal guardians.

Because the Platform is intended for minors:

• User accounts must be created by a parent or legal guardian.
• Parents or guardians are responsible for supervising a child's use of the Platform.
• Parents or guardians represent and warrant that they have the legal authority to consent to the child's use of the Platform and to the collection and processing of information required for the provision of services.

By creating an account on behalf of a child, the parent or guardian accepts these Terms on behalf of the child.

ACCOUNT REGISTRATION

To access certain features, users may be required to create an account.

You agree to:

• Provide accurate, complete, and current information.
• Maintain the confidentiality of login credentials.
• Prevent unauthorized access to your account.
• Notify Twiggle immediately of any suspected unauthorized use.

You are solely responsible for activities occurring under your account.

Twiggle reserves the right to suspend or terminate accounts containing inaccurate information or accounts used in violation of these Terms.

SUBSCRIPTIONS, FREE TRIALS AND PAYMENTS

Certain services may be offered through paid subscriptions.

Free Trial

Twiggle may offer free trial access to certain services. Upon expiry of the free trial period, continued access may require a paid subscription.

Twiggle reserves the right to modify, withdraw, limit, or discontinue free trial offers at any time.

Promotional Plans and Discounts

Twiggle may offer promotional pricing, discounts, referral benefits, trial offers, introductory pricing, or other special programs from time to time.

Unless expressly stated otherwise, promotional offers are temporary, may be modified or withdrawn at any time, and cannot be combined with other offers.

Subscription Plans

Subscription plans may include:

• Monthly plans
• Annual plans
• Promotional plans

Current pricing shall be displayed on the Platform.

Billing

By subscribing, you authorize Twiggle and its payment service providers to charge the applicable subscription fees.

Users are responsible for maintaining valid payment information.

Cancellation

Users may cancel subscriptions at any time through the Platform or designated support channels.

Cancellation will take effect at the end of the current billing cycle.

Access to paid features will continue until the end of the subscription period already paid for.

Refund Policy

All subscription payments are final and non-refundable except:

• Duplicate payments;
• Payment processing errors; or
• Situations where refunds are required under applicable law.

No partial, prorated, or unused subscription refunds shall be provided.

Refund requests, where applicable, must be submitted through Twiggle's designated support channels and may be subject to verification and review.

Failed Payments

If a payment cannot be successfully processed for any reason, including expiration of a payment method, insufficient funds, payment provider errors, or other circumstances, Twiggle may suspend, restrict, or terminate access to paid services until payment is successfully completed.

Automatic Renewal

Unless auto-renewal has been disabled or the subscription is cancelled prior to the end of the applicable subscription period, subscriptions may automatically renew for successive periods equal to the original subscription term.

By subscribing, you authorize Twiggle and its payment service providers to charge the applicable subscription fees for each renewal period using the payment method on file.

Users may cancel auto-renewal at any time through the Platform or designated support channels. Cancellation will take effect at the end of the current billing cycle.

Changes to Pricing

Twiggle reserves the right to modify subscription fees, pricing plans, features, benefits, or service offerings at any time.

Any changes to pricing shall apply prospectively and shall not affect subscription periods already paid for by the user.

Taxes

All applicable taxes, including Goods and Services Tax (GST), shall be charged in accordance with applicable laws and regulations unless expressly stated otherwise.

ACCEPTABLE USE

Users agree to use the Platform only for lawful educational purposes.

Users shall not:

• Violate applicable laws or regulations.
• Upload malicious software, viruses, or harmful code.
• Attempt unauthorized access to systems or data.
• Interfere with the operation of the Platform.
• Reverse engineer, decompile, or attempt to discover source code.
• Use bots, scrapers, automated tools, or scripts without authorization.
• Circumvent platform safeguards or security measures.
• Impersonate another individual or entity.
• Misrepresent their identity.
• Use the Platform for commercial purposes without written consent.

Any violation may result in suspension or termination of access.

AI-POWERED FEATURES

Twiggle utilizes artificial intelligence, machine learning systems, automated decision-support tools, and large language models to deliver certain Platform features.

These features may include:

• Explanations
• Learning guidance
• Feedback generation
• Question answering
• Recommendations
• Learning analytics
• Assessment assistance

Users acknowledge and agree that:

• AI-generated outputs may contain inaccuracies, omissions, misunderstandings, or outdated information.
• AI-generated content is probabilistic and may not always be correct.
• Users should independently verify important information.
• Educational decisions should not be based solely on AI-generated outputs.
• Twiggle does not guarantee the accuracy, completeness, reliability, or suitability of AI-generated responses.

Twiggle continually improves its AI systems but cannot guarantee error-free outputs.

‘ASK TWIGGLE’ CHATBOT

The "Ask Twiggle" feature is intended solely for educational assistance.

Users agree not to:

• Share passwords or authentication credentials.
• Share financial information.
• Share sensitive personal information.
• Submit unlawful, harmful, abusive, or inappropriate content.

While Twiggle implements safeguards designed to maintain age-appropriate and curriculum-relevant interactions, no automated system can guarantee perfect performance in every situation.

EDUCATIONAL DISCLAIMER

Twiggle is intended as a supplementary learning tool.

Twiggle does not:

• Guarantee improved academic performance.
• Guarantee examination results.
• Guarantee admission to educational institutions.
• Guarantee scholarships.
• Guarantee specific grades or scores.

Educational outcomes depend upon numerous factors beyond the Platform, including:

• Student effort
• Attendance
• Study habits
• School curriculum
• Teaching quality
• External circumstances

EDUCATIONAL CONTENT DEVELOPMENT, CURRICULUM ALIGNMENT AND COPYRIGHT COMPLIANCE

Twiggle uses educational reference materials, curriculum frameworks, syllabus objectives, learning standards, and other educational resources to develop and generate learning content for educational purposes.

The Platform is designed to provide independently generated explanations, examples, assessments, feedback, learning pathways, and educational support. While educational reference materials may inform the development of Platform content, Twiggle's objective is to present concepts in an original, interactive, and educationally effective manner.

The Platform is not intended to reproduce, distribute, replace, or serve as a substitute for copyrighted textbooks, educational publications, or other proprietary instructional materials.

Educational content available through the Platform is independently created, organized, adapted, generated, or curated by Twiggle for instructional purposes.

Educational concepts, definitions, terminology, formulas, learning objectives, and subject matter taught through the Platform may naturally overlap with content covered in school curricula, textbooks, reference materials, and educational publications.

Any similarity between Platform content and third-party educational materials may arise from the common subject matter, curriculum requirements, educational standards, or established academic terminology being taught.

Twiggle endeavours to create and present educational content in a manner that is independently developed, adapted, generated, or curated for educational purposes. Twiggle may implement content review, quality assurance, and other reasonable measures designed to reduce unintended reproduction of third-party copyrighted materials.

References to educational boards, curricula, subjects, grades, chapters, topics, learning objectives, educational standards, or textbook topics are provided solely for educational alignment purposes and do not imply any affiliation, endorsement, sponsorship, certification, approval, or authorization by any educational board, publisher, examination authority, government agency, or educational institution.

Twiggle respects the intellectual property rights of educational boards, publishers, authors, and content owners. If any copyright owner believes that content available through the Platform infringes their intellectual property rights, they may contact Twiggle with sufficient details of the alleged infringement. Twiggle will review such requests in good faith and take appropriate action where necessary, including the modification, restriction, or removal of content where appropriate.

USER CONTENT

Users may submit:

• Assignments

• Chat interactions
• Feedback
• Reports

Users retain ownership of their submitted content.

By submitting content through the Platform, users grant Twiggle a non-exclusive, worldwide, royalty-free license to:

They should not be considered:

DATA USE FOR PLATFORM IMPROVEMENT

Users acknowledge and agree that Twiggle may use anonymized, aggregated, de-identified, and pseudonymized data derived from platform usage to:

• Improve services;

• Improve AI systems;
• Train and refine machine learning models;
• Improve safety systems;
• Conduct research and analytics.

Twiggle will take reasonable measures to remove or minimize personally identifiable information before using data for such purposes.

INTELLECTUAL PROPERTY

All rights, title, and interest in the Platform remain the exclusive property of Twiggle Labs Private Limited.

• Trademarks
• Branding

No ownership rights are transferred to users.

Users may not copy, reproduce, distribute, modify, publish, sell, or exploit any Platform content without prior written permission.

THIRD-PARTY SERVICES

The Platform may contain links to third-party services, websites, applications, or payment providers.

Twiggle does not control and is not responsible for:

• Third-party services;
• Third-party privacy practices;
• Third-party availability.

Use of third-party services is at the user's own risk.

PLATFORM AVAILABILITY

Twiggle strives to provide reliable service but does not guarantee uninterrupted availability.

The Platform may occasionally be unavailable due to:

• Circumstances beyond our control.

Twiggle reserves the right to modify, suspend, discontinue, or replace any feature at any time.

TERMINATION

INDEMNIFICATION

CHANGES TO THESE TERMS

Twiggle may update these Terms from time to time.

Updated versions will be posted on the Platform with a revised effective date.

Continued use of the Platform after such updates constitutes acceptance of the revised Terms.

GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these Terms, the Platform, or the services provided by Twiggle shall be subject to the exclusive jurisdiction of the courts located in Thane, Maharashtra, India.
